Putrya also maintains that the Plenum of the Supreme Court would be well advised to adopt a new resolution providing clear guidance on the most complex and contentious issues arising from the application of the Merchant Shipping Code. The need for such clarification is long overdue: over the 25 years since the Code came into force, courts have produced a substantial body of judgments that frequently contradict one another. The principal document providing such guidance, an Information Letter issued by the Supreme Commercial Court in 2004, has become obsolete and fails to reflect many of the issues faced today, the NAVICUS.LAW partner concluded.
