The recent Maritime Arbitration Forum in Moscow brought together more than 200 participants. NAVICUS.LAW served as the event’s principal partner. Our firm was represented by Partner Konstantin Putrya and Senior Associate Denis Chistyakov, who took part in the programme as speakers.
Konstantin explained how the use of the “subject to” condition can be decisive for both the contract and arbitration. While under English law a “subject to” clause operates as a pre-condition, under the Russian legal system, this clause may be construed differently, the expert explained, illustrating his point with a specific case.
Denis’s talk drew considerable interest from shipowners, as it examined the mechanism by which their liability may be limited. Properly applied, this legal instrument can help shipping companies retain significant funds and avert insolvency.
